Federal Court Mandates Freedom of Kilmar Abrego Garcia from Immigration Detention
A court has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment is without lawful basis.
"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her ruling.
The situation originates in a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an mistake. Following his repatriation to the United States to answer alien smuggling charges, he was detained in federal detention.
In her order, the court pointed out that the authorities does not have a current deportation order, which prevents them from deporting Mr. Abrego Garcia "at this time."

The court proceedings involve disputed assertions. Whereas the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently denies this claim.
